Freedom is a right, NOT A PRIVILEGE, right?

Freedom is a right. And under some circumstances, even if the law is broken. The Supreme Law of the Land is the U.S. Constitution. If that law is violated by the government, then the law created becomes insignificant. It just depends on if the law created violates the Constitution. No government authority can override the Constitution.
